Are Sex Offender Laws In The State of Maine Fair?

Clearly, sex offender laws are on the books to keep the public safe. But, the variety of crimes that might get you included on the sex offender registry run the gamut. No matter what level of seriousness you might perceive the accusation to be, you absolutely need a lawyer if you get accused of a crime that might end with your name being added to the sex offender registry.

Are the sex offender laws in the state of Maine fair?

Here in the state of Maine we’ve seen a large increase in charges of gross sexual assault or rape. And there are many different kinds of gross sexual assault in Maine.

One of the things we’ve seen a lot recently is that people who patronize prostitutes are being charged more and more. Sometimes with felony gross sexual assault. Folks who are involved in the sex industry or sex traded many many more people, both practitioners are being charged with crimes. There’s a real emphasis right now in the state of Maine trying to track down the problem of human trafficking particularly sex trafficking. And so called pimps or johns are being prosecuted much much more vigorously than they ever have been.

This is a new from phenomenon in the past year or so but we seeing a lot more of these kinds of cases. If one is convicted of gross sexual assault, that person will be on the sex offenders registry for the rest of their lives in most cases. And so these are extremely serious cases. Even if the facts look like it’s not that big a deal, even if we are able to secure a very small amount of time in jail, the fact is being on the sex offenders registry will follow a person for the rest of their life. And will have very serious consequences for housing for employment. It makes life very very difficult.

When people are listed on the sex offender registry often times it’s hard to tell how serious the actual crime was that get them on there. So you can have a person on the sex offender registry who’s legitimately a dangerous individual who is seeking to maybe assault women in the dark in the park. And also right next to them on the sex offenders registry you could have someone who thought they had consent to have sex with someone and it turns out she was asleep. And they are terribly sorry and they never wanted to happen again.

And so the second person is plainly not dangerous moving forward, the first person plainly is and both of those folks could be on the sex offenders registry for the rest of their life. So any kind of sex crime, we’re seeing a lot more of right now, and the consequences are just so huge that it’s a little scary that you absolutely have to have a lawyer as early in the process as possible.
