If your child is accused of a crime or if your child is arrested or accused of a crime without being arrested, it is extremely serious matter. It is not something to be taken lightly. When your child goes into the criminal courts for the first time, you’ll understand quickly how serious it is. The state is accusing that child of committing a crime against the people of the state of Maine. And the judge and the prosecutors will take it extremely seriously. So the most important thing you can do is hire a lawyer. I mean you just need one. And you want one as early as possible in the process.

Thankfully in the juvenile system there are a lot more resources that the state of Maine or other care providers can provide to the family unit to try and make sure that there is not further trouble or that there’s no further police conduct. The family is provided with some services that help resolve whatever problems are going on at home, if any.

The fact remains that if you are convicted of a juvenile crime by either pleading guilty to that crime or being found guilty at a trial in front of a judge that convection has consequences. Certainly the state has the power to lock you up and that would take you away from your family and have consequences beyond just that criminal defense. The state can also take money away from the family in the form of restitution or fines. And also that conviction itself in some cases even in juvenile law will follow you into adulthood and that can have serious consequences just like any other adult criminal conviction, on jobs, on schools, on family life, really everything.

As a parent, if your child is accused of a crime it’s important to get a lawyer on board as soon as possible. That lawyer will officially represent just the juvenile and not the rest of the family. At H&H Law center and any good juvenile attorney understands that whatever is going on with the kid is also implicating the larger family unit. So the larger family unit has to be part of that conversation, if you’re going to resolve the case in any sort of compassionate family matter. There are some ethical boundaries around that. For example the mother of a client is not my client and there may be some confidentiality issues but generally speaking if everyone consents, it makes a lot of sense to have the rest of the family unit around the table so that we discuss what the options are and how best to reduce risk.
